Below are shown terms and conditions that regulate the access to the website www.anteprimaextra.com (also referred to as "the Website"). By entering the Website, users agree to our legal terms and to conform to all the regulations herein stated.

Anteprimaextra.com reserves the right to ask users who do not agree or do not conform to these terms not to enter the Website. The access to the Website and to the related services is exclusively for personal use.
The Website provides users with information about the products shown and the opportunity to buy the aforementioned products.

General Conditions of Sale 

These general conditions of sale (”General Conditions”) regulate the sale of items (the "Products") marketed by Progetto Moda s.r.l. (here called ”PM”) through the website www.anteprimaextra.com (the "Website").

All Products sales contracts from PM to third parties purchasing items through this Website (the "Customers") are regulated by these General Conditions, which are an integral and essential part of any proposal, order and placement of a purchase order for the Products. PM reserves the right to modify these General Conditions. Sales conditions applied to the orders are those in force at the moment of placing the order. It is up to the Customer to read these General Conditions to check the applicable terms before placing an order.

The General Conditions here presented regulate distance selling in accordance with the Italian law, article 50 and consecutive of "D.Lgs no. 206 del 6 settembre 2005", known as "Codice del consumo", "sezione II del capo I del Titolo terzo della Parte terza", to refer to as specified in "art. 60 del Codice del consumo", and in compliance with electronic commerce regulations stated in the "D.Lgs. n. 70 del 9 aprile 2003". These General Conditions are also based on the regulations of the EU directive 2011/83/EU of 5th October 2011as regarding more favourable provisions for the Customer compared to the internal conditions, where that can be derogated.

1. METHODS AND TIMING FOR THE CONCLUSION OF THE CONTRACT

According to these General Conditions PM sells and the Customer buys online the Products presented and sold on the website www.anteprimaextra.com. The contract is accomplished exclusively on the Internet, through the Customer's access to the Website and the fulfillment of a purchase order according the Website process and subject to order confirmation.

The correct fulfillment of a Product order by the Customer represents the contract proposal of said order. The sale is to be considered accomplished as soon as PM sends to the Customer an order confirmation via email, to the address entered by the Customer at the moment of the order or user registration. The email contains all Customer and order info, the total amount of the purchase, shipping costs and the Customer's shipping address. The Customer commits to verify the accuracy of the information contained in the email and to contact us immediately for any correction. PM cannot accept information corrections received after Product shipping and invoice issuing. 

PM reserves the right not to confirm the purchase proposal received with the order, due, for example, to a Products supply issue, or to incongruities and criticalities presented by the order received. PM also reserves the right to subordinate the order confirmation to the reception of additional information and/or clarifications sent by the Customer via email.

2. PRODUCTS

Each Product is presented with photos for every colour available, a table for size selection and a table for item details and composition.

The e-shop customer service can be contacted from the "Ask" tab inside the Product sheet for further information about the Product wearability, measures and single sizes.

PM commits to describe and present Products in a detailed and accurate way, offering as much information as possible about technical and aestethic features, detaila and quality.
However, some errors, imprecisions or differences between the virtual presentation and the actual Product may emerge. PM refuses any responsibilities for any of these cases.

Product photos used to present the items are not a contractual feature, as they are only for representative and explanatory purpose. 

Technical and functional features of the Products published by PM contained in the Products sheets, are those sent by producers. PM declines any responsibility for the truthfulness and completeness of the said information. 

Products are not available for fitting. PM customer service can provide the Customer with additional information about the Products. The Customer is responsible for the choice of ordered Products and for their compliance to the Customer's requirements. 

3. PRICES

Unless otherwise agreed, Products prices published on the website by Anteprima are in Euros and are VAT included.

In order to provide a more comfortable shopping experience to foreign customers using a different currency, the Website may show prices in the main currencies for international transactions (i.e.: GB pounds). The conversion is to be considered as merely approximate. The amount debited on the Customer's credit card or PayPal account may differ, as it is based upon exchange rates fluctuation and on bank commissions applied at the time of purchasing the item.

It is therefore up to the Customers using non-Euro currencies to contact their bank to ask for detailed information about exchange rates and bank commissions for the transaction in Euros for the order possibly confirmed or that the Customer wishes to confirm.

The Customer agrees to the right of PM to modify items price at any time. New product prices published on the Website will completely supersedes the previous prices and are subject to Product availability.

The price guaranteed to Customers is that published on the Website at the moment of the fulfillment of the order. The price set at the moment of the purchase is fixed and final, and will not be subject to possible changes. 

4. SHIPPING COSTS

Delivery costs are not included in the price shown in the Product sheet, but are stated and calculated at the moment of completing the purchasing process, before the order confirmation and the checkout.

The Customer can refer to the page "Shipping" to know the delivery time. Shipping costs are also calculated on the destination, and will be added at the moment of placing an order.

Possible import taxes and customs charges are not included in the price shown in the Product sheets.

5. PRODUCT AVAILABILITY

Product availability stated in the Product sheet (as regarding size and colour) refers to the actual availability at the moment of visiting the Product sheet. However, this is to be considered as merely approximate, as Products may be purchased by other Customers before the order confirmation. Products added to the cart are not reserved and/or optioned: until the Customer does not place the order, the Product may be purchased by other Customers.

Even after receiving the email Order Confirmation by PM, there may be an unavailability of the ordered Products. Should this happen, the Customers will be promptly informed via email of the unavailability and of the extimated shipping time for the supply of said Product. The Customer can choose to wait for the Product supply times or to cancel the order, sending PM an email. The amount paid for the unavailable item will be credited to the Customer.

6. PAYMENT

Payment is due at the moment of accomplishing the order process, that is the moment the Customer has chosen one or more Products and entered his personal information and the has chosen the payment method, and then clicks on "Login and purchase" (for registered users) or "Register and purchase" for new users.

Every payment sent by the Customer can only happen by one of the credit cards shown on the Website (please refer to this page) or via PayPal.

6.1. Credit card payment

At the moment of purchasing items, Customers enter credit card details in a secure bank system provided by Moneta Web. Further information about this system can be found here.

Any communications related to the payment and the Customer's information take place on specific secure lines and with all the guarantees provided by the security protocols adopted by payment circuits.

In order to guarantee more secure purchases, PM strongly recommends to its Customers to sign up to services like Verified by Visa or Mastercard Securecode, by requesting a PIN code, for even more secure online transactions.

6.2. PayPal payment

Customers can pay for their purchases via their PayPal account. PM reserves the right to ship items solely to the address associated to the Customer's verified PayPal account, irrespective of the different shipping address possibly indicated by the Customers.

6.3. First purchases - New customers

For customers placing an order for the first time on this Website (from now on called "New Customers"), PM reserves the right to ask its bank or PayPal to verify the transaction, also by questioning the New Customer's bank, before carrying the order out. PM also reserves the right to ask New Customers to ship the order solely to the invoicing address, irrespective of the different shipping address possibly indicated by the New Customer. The order confirmation and fulfillment will then be subject to the New Customer's willingness to conform.

When fulfilling the order, the New Customer pledges himself to PM to have the necessary authorisations for paying by credit card or PayPal, and to have the necessary means to positively fulfill the transaction.

Once PM receives the the transaction confirmation, the order will be executed by shipping the purchased item/s.

7. INVOICE ISSUE AND TRANSMISSION

For each confirmed order, PM issues an invoice and ships the items. The invoice will be based on the information provided by the Customer when placing the order. After the invoice issue, the data therein stated cannot be modified.

The invoice will be sent to the email address specified by the Customer for this purpose, plus the communication of the delivery to the courier. The paper invoice will be shipped to the Customer along the parcel.

8. EXECUTION OF THE ORDER

8.1. Shipping

The order will be carried out according to times and costs stated on the page "Shipping".

PM undertakes to deliver the items within 10 days from the day after the order confirmation day.

Except for New Customers, as defined in point 6.3. Despite receiving the order confirmation, PM reserves the right to question the New Customer's bank for the payment order arranged and to only process the order after a confirmation of the reliability of the transaction. In this case, the order will be shipped within 10 days from the receipt of a confirmation from the New Customer's bank.

Delivery time is always stated in weekdays.

Orders are dispatched by Progetto Moda S.r.l., Altamura - Italy, from Mondays to Fridays, from 9.30 am to 6 pm. Orders confirmed on Fridays in the afternoon , on Saturdays and Sundays will be carried out on the following Monday morning. Sundays, public and religious holidays are not included.

Products will be delivered by express courier to the address stated by the Customer during the order. 

Shipping will be carried out as soon as the payment transaction is confirmed by the payment processing network (credit cards or PayPal).

Products shipped always travel with a shipping insurance against theft and accidental damage). The insurance expires as soon as the Product is delivered. The delivery is considered as carried out at the moment the parcel is delivered to the Customer's address and collected by the Customer or an authorized person. 

The delivery note issued by the courier must be filled in with date of receipt and signed by the Customer (or authorized person) as soon as the Product is collected, and that act as proof of the goods' shipping and release.

8.2. Delivery to the Customer

a) Check conditions of the delivered Product

On delivery, PM recommends the Cusomer verify the overall state of the Product(s) before signing the delivery note. In particular, the Customer must verify that:

Should the Customer note any anomalies, he/she must refuse to accept the delivery of the Products or he/she can report detailed reserves, that have to be put in writing and dated. The Customer must communicate to PM his/her refused delivery or received unchecked.
Once the the delivery note is signed with no "reserve", the Customer will not be able to question the external conditions of the delivered Product. 

b) Check that the delivered Product is undamaged and matching with the one displayed on the Website

Should the Customer encounter some anomalies of the Product (i.e.: integrity and/or conformity or completeness of the Products received with regards to the Products ordered and confirmed) must notify that to PM within 3 (three) days from the delivery.

c) Deliver of the Products - absent Customer

Should the Customer be absent during the delivery, the courier will leave a note at the Customer's delivery address. The Products will have to be collected by the Customer at the address and following the method specified by the courier. If the Customer does not collect the package within the deadline indicated by the courier, Products will have to be returned to PM. PM reserves the right to refund the Product price, deducting the return shipping and possible custom charges, which will be at the expenses of the Customer who has not collected the Products. Postal warehousing costs until the collection or until the return to sender are always to be considered at the Customer's expense.

d) Unsuccessful delivery because of the Customer

By confirming the order, the Customer undertakes to do whatever it is necessary and useful to allow the delivery of the Product and to accept said delivery. Should the courier not be able to deliver the Product because of the Customer (i.e.: wrong address, always absent recipient, wrong telephone number, etc.) or if the Customer refuses to accept the delivery, shipping costs and possible custom charges will be deducted from the refund due to the Customer.

e) Unsuccessful delivery for force majeure

PM declines all responsibilities for possible delays and/or disruptions due to force majeure or by chance, or due to malfunctioning and disruptions of the Internet in the event that PM cannot execute the order according to the scheduled time (as specified in these General Conditions and in the order confirmation details).

The following events are considered as force majeure, in addition to those considered by law:

- total or partial strikes, within or external to PM, a stop of means of transport of supply for any reason, government or law restrictions, computer breakdown, telecommunication interruptions, including networks, especially the Internet.

In the event that the two parties ascertain the persistence of the force majeure case after 3 (three) months, the order will be automatically cancelled, unless agreed otherwise between the parties. 

9. RIGHT OF WITHDRAWAL

9.1. Deadline

The Customer, if qualified as "Consumer" according to the current regulations, has the right to withdraw from the purchase with no sanction and without specifying the reason. The right of withdrawal fixed by PM can be exercised within 14 days (more than the minimum required by the Consumer's Code. This deadline becomes effective from the delivery of the Products to the Customer's address.

9.2. Procedure

In order to exercise this right, the Customer must send to PM (according to the terms stated above) a written declaration, stating as follows: 1) order number; 2) invoice number; 3) Customer's name; 4) Customer's email address; 5) Customer's phone number (optional); 6) code, description and brand of the Product to return, specifying the quantity if over one unit; 7) additional comments (optional).
The withdrawal declaration can be sent indifferently to: a) by email to info@anteprimaextra.com; b) by fax to +39080 311 8444; c) by registered leter with acknowledgement of receipt to: Progetto Moda S.r.l. Piazza Zanardelli, 11, 70022, Altamura (Bari, Italy).
Once we have received the withdrawal declaration, PM will immediately transmit to the Customer the univocal code for the return of the goods. The Customer must use this code to return the Product via the courier specified by PM, following the instructions provided.
The Product must be returned within 14 days from the returned goods code notice. In order to respect the deadline, the Product is considered returned when it is consigned t the courier specified by PM.  

The integrity of the Product is the fundamental condition to exercise the right of withdrawal. The Anteprima original label and the seal to which is fastened must be attached to the Product and cannot be removed for any reason.
The Product label and all the identification stickers must neither be cut nor broken. Products must not be worn (only tried on without removing labels or stickers), washed or altered and must not present any mark of use. Shoes soles must be in perfect condition and not present any mark.
Each Product must be returned with all its labels, packages and original accessories (boxes, bags, hangers, suit covers, etc.) received along the Product.
All shoes and accessories must be returned with their original box, which is an essential part of the Product itself and must not be anyhow damaged and/or altered, and must not be used as the sole shipping package.
Bathing suits and underwear (bikinis, panties, boxer shorts, etc.) must be tried on upon the Customer's own underwear. The return of these items will be refused and sent back to the Customer if the hygienic protection has been removed or the Products present marks of use. The exterior package must be the Anteprima branded package received by the Customer, whether undamaged and/or unaltered while opening and otherwise replaced with an equally solid and resistance package.

Products must be returned with the related fiscal documents.

9.3. Acceptance of return

Once we receive the parcel with the Product stated in the return declaration, within the deadline specified in point 9.2, and once we have verified its integrity as described in point 9.2, PM will refund the Customer with the amount due for the retuned Products as soon as possible, within a maximum of 30 days.

9.4. Returns for Products' faults or nonconformity

In the event of faulty or non-compliant Products, the Customer must send an email to PM (info@anteprimaextra.com) with a return application, following the same procedure as in points 9.1 and 9.2, using the "Additional comments" field to describe the faults or nonconformities encountered, and also stating if he/she wishes to replace the Product or to be refunded. PM may ask the Customer to provide us with one or more photos showing the problem encountered.

After having examined in depth the photographic proof, PM will send to the Customer the return authorization number and all the necessary instructions to ship the Products. PM then reserves the right to verify the nonconformity. If ascertained, PM will ship the substitute Products (subject to availability in stock) or refund the Customer by crediting the amount due on the card used during the transaction.

During the withdrawing period (between the delivery to the Customer and the delivery to the courier, after having received the authorization to return the Product) you will be the guardian of the Product and therefore responsible for the Product. The right of withdrawal will expire in the event of damage or destruction of the Product during the custody period.

Custom or tailored Products are not included in the right of withdrawal as in points 9.1 and 9.2.

10. PERSONAL INFORMATION

The computerised processing of the Customers' personal data, including email addresses of the Website users, is accomplished in accordance with the provisions of Italian law. Personal information required are essential to elaborate and process the orders, to issue invoices and warranties.

Personal infomration may be passed to PM's partners in order to carry these operations out.

The Customer can oppose to this data transmission and can access, modify, amend and cancel his/her personal information by addressing to Progetto Moda S.r.l., P.zza Zanardelli 11, 70022 - Altamura (Bari, Italy).
To avoid any fraud, PM has the right to ask proof of the Customer's identity and/or domicile and/or legitimateness to use the method of payment specified. The order confirmation will be subject to the Customer's willingness to provide the proof required by PM.

11. VALIDITY OF GENERAL CONDITIONS - NULLITY AND/OR  PARTIAL INEFFICACY

These General Conditions are composed by the entirety of its clauses. Should one or more of these General Conditions of Sale be declared not valid and/or ineffective by the competent Judiciary Authority, the remaining dispositions will continue to have full force and efficacy.

12. APPLICABLE JURISPRUDENCE AND JURISDICTION

These General Conditions are regulated by the Italian law.
Each controversy that should not be resolved in a friendly manner, will be presented to the exclusive competence of the Court of the Customer's place of residence or domicile, if located on the Italian territory and if the Customer who has bought the Product in question can be qualified as "Consumer" according to the current regulations.
Any other controversy that may emerge from relationships partially or entirely regulated by these General Conditions, will be transferred to the exclusive competence of the Court of Bari.

Pursuant to and by effect of the articles 1341 and 1342 of the civil code, the Customer declares to have carefully read and understood and to accept specifically the following clauses of PM's General Conditions of Sale: 1-2-3-4-5-6-7-8-9-10-11.
